A piece may be purchased for the retail value at any time. 50% of previously paid rental fees will be applied against the price.
RENTAL CONTRACT
1. General Rental; Adult Agreement Required
You agree and acknowledge that You are renting the Piece and that ownership of, and title to, the Piece remains with the Artist, unless and until a purchase of the piece is completed. The number of Products that can be rented by You in our sole discretion. Our Pieces may only be rented by persons 18 years of age or older, using cheque or other approved payment method.
2. Rental Fees; Renewals
The “Rental Fee” for a Piece will be the rental fee and delivery charges(if applicable) as stated in ‘Rental Fees’ list in connection with Your rental of the Piece. The rental period starts on the 1st of every month, quarterly. Upon Your rental of a Piece, a cheque for the first rental period will be collected. For your convenience, the cheque may be post-dated till the 15th of that month. We reserve the right to increase the Rental Fee with thirty (30) days advance notice to you. We reserve the right to collect deposits for certain Pieces in our sole discretion.
We will assume that You are enjoying Piece unless we hear otherwise from You, so You agree that we may automatically renew your rental on a quarterly basis, and collect payment on the 1stof that month. Cheque may be post-dated till the 15th
3. Our Commitments to You
a. Delivery to You. We will deliver the Pieces to You. Our liability to You for failure to deliver the Piece is limited to the timely delivery of Piece or a refund of the Rental Fee or Purchase Price as determined by us.
b. Color Reproduction. We make efforts to display the Pieces and their colors as accurately as possible, but Pieces may appear different in color and texture than the photos displayed on our Website.
c. Returns. With delivery of the Piece, we will provide contact information to be used to arrange for the return transportation of the Piece. Either You or Artist can request that the Piece be returned at any time by notifying the other party. The Piece will be picked up within 30 days of notification at no additional fee to You. You will be responsible for all Rental Fees accrued up until the date the Product is returned.
d. Purchases: If You at any time decide to purchase a rented Piece at the provided retail value, Artist will deliver a signed Certificate of Authenticity upon receipt of payment.
e. Services: We offer consultation and installation(if applicable) of Pieces for an additional fee
f. Right of First Refusal. In the event you are the current renter of a Piece, and an offer to purchase such Piece is made, we agree to use reasonable efforts to offer you the opportunity to purchase such Piece at the offered price, under our standard terms and conditions. We will use reasonable efforts to hold this right of first refusal open for 3 days. If you decline, or we cannot contact you, you agree to make the Piece available as soon as possible, and in all cases within 15 days. We will not be liable to you or any third party if we sell a Piece currently in your possession
4. Your Commitments to Us; Payment of Retail Value
a. Receipt of the Products. Upon delivery to you, You bear responsibility for the Piece, including risk of loss. You acknowledge that a Secure Shipping Address (defined herein) is highly recommended. A “Secure Shipping Address” is a location where an individual can physically receive Piece(s). In the event that an unsecure shipping address is provided, Artist does not bear liability for Pieces left unattended. Furthermore, You acknowledge that providing anything other than a Secure Shipping Address may result in delivery delays and additional delivery fees for which you, and not the Artist will be responsible.
b. Use of the Products. You agree to treat each Piece with great care, as if it was borrowed from Your close friend (or your most obsessive aunt). Your insurance covers any Accidental Damage to the Product while it is in your possession. Examples of Accidental Damage include scratches, chips, damage to hanging devices, small tiers, and other incidents as determined by us in our sole discretion. Accidental Damage does not include theft. If a Piece is damaged while in your care, You agree to pay the full retail price of that Piece
c. Continued Rental. You agree to continued payment of the Rental Fee on a quarterly basis until the Artist is notified of your Rental termination or decision to purchase the Piece. Upon Rental termination, the Piece will be picked-up by Artist within 15 days.
d. Payment of Retail Value. If You elect to purchase the Piece, you may notify us. You will pay us the full Retail Value and the Piece will be Yours to keep upon payment. 50% of previously paid rental fees will be deducted from the retail value of the Piece.
e. Collections. If You do not pay the amounts You owe to us when , upon termination of these Rental Terms, we may take possession of the Piecde, then we will need to institute collection procedures. You agree to pay our costs of collection, including without limitation reasonable attorneys’ fees. Any amounts not paid when due shall bear interest at the rate of 1.5% / month.
f. Removal. We reserve the right to terminate your rental Pieces from us at any time should You breach these Rental Terms or any reason in our discretion. Without limiting our other rights under these Rental Terms wherever situated if not returned in the permitted period of time, without court order or liability for entering the premises.
5. Details on Our Commitment to You.
a. Limited Warranty. We ensure that the Pieces are the original work of the Artist.
6. Limitation of Liability.
YOU ASSUME SOLE AND EXCLUSIVE RESPONSIBILITY AND LIABILITY FOR ANY CLAIMS AGAINST YOU AND/OR DAMAGES ARISING FROM USE OF THE PIECES DURING YOUR RENTAL PERIOD.
